Types of motoring legal claims

London is a very busy town for driving, and anyone can find themselves responsible for a motoring offence. If you are found culpable of a driving offence, such as speeding, drink driving or reckless driving, this can leave you liable both to fines but also to the loss of your driving licence; the latter of which can be disastrous for anyone needing their vehicle to get to and from work, or for working itself. These are a couple of the most frequent types of legal issues motorists face.

Drink driving

The problem many have, with regards to drink driving, is an inability to understand that they do not have to be drunk to be guilty of it. Many people choose to drive under the influence of alcohol because they are sure that they are fully in control, but they may still be well over the legal limit. You can be required to stop your vehicle and submit to a breath test at any time, but only if the police officer making the request has reasonable cause to believe, firstly, that you committing a motoring offence and secondly, that you are over the legal limit once you have stopped the car. If you are charged, found guilty and subject to a driving ban of longer than two years, you can apply to have the remaining period lifted after serving two years of the ban.

Speeding

The area of motoring law related to speeding exists for very good reasons, as this is a common cause of accidents and deaths on the roads. If you are caught speeding, you will generally receive a Notice of Intended Punishment, which you have 28 days to respond to. Failure to do so can result in punishments of cash fines and points on your driving licence. However, more serious speeding offences can lead to criminal charges being brought which, if the driver is found to have been 30mph or more over the speed limit, can lead to him or her being disqualified from driving for a fixed period.
